Glonghui March 27 — According to the China Trade Remedy Information website, on March 26, the United States International Trade Commission (ITC) voted to initiate a Section 337 investigation (Investigation Code: 337-TA-1492) into Certain NAND and DRAM Memory Chips. On February 17, 2026, MonolithIC 3D Inc. of Allen, Texas filed a Section 337 complaint with the US ITC, alleging that exports to, imports into, and sales within the US of these products violate Section 337 of US law (infringing US registered patents No. 12,035,531, 12,125,737, 12,243,765, 11,342,214, 11,476,181, 11,594,473, 11,862,503, 12,225,737), requesting that the US ITC issue a limited exclusion order and a cease and desist order. The named respondents include KIOXIA Holdings Corporation, Tokyo, Japan; KIOXIA Corporation, Tokyo, Japan; KIOXIA America, Inc., San Jose, California; KIOXIA Engineering Corporation, Nagoya, Japan; KIOXIA Iwate Corporation, Iwate, Japan; KIOXIA Systems Co., Ltd., Kanagawa Prefecture, Japan; KIOXIA Semiconductor Taiwan Corporation, Taipei City, Taiwan; SK hynix Inc., Gyeonggi-Do, Korea; SK hynix America Inc., San Jose, California; and SK hynix Memory Solutions America Inc., San Jose, California. The United States International Trade Commission will determine the target date for completion of its investigation within 45 days after institution. Except where the US Trade Representative disapproves on policy grounds, the remedies issued by the US ITC in Section 337 cases take effect upon issuance and become final on the 60th day after issuance.
